The entire howard-partners.com website (hereinafter referred to as the “Site”) is subject to French legislation and, as such, protected by the provisions of the French Intellectual Property Code and, in particular, by the provisions relating to literary and artistic property, copyright, and database protection. These rights are the exclusive property of HOWARD. We remind you that the French Intellectual Property Code only authorizes, under article L.122-5, copies and reproductions strictly reserved for the private use of the copier and not intended for collective utilization, and analyses and short quotations for the purpose of example or illustration.  

Likewise, article L.342-3 of the French Intellectual Property Code only authorizes the extraction or reutilization of a non-substantial part of the content of databases made available to the public by their holder. Consequently, any unauthorized representation or reproduction of the Website, by any means whatsoever, is strictly prohibited on pain of legal proceedings.

This policy describes the manner in which HOWARD, in its capacity as responsible for processing data under the existing General Data Protection Regulation (GDPR), processes users’ personal data (hereinafter, the “Data”).

Data protection

HOWARD implements technical and organizational security measures in accordance with the state-of-the-art. This particularly concerns the security of its information system. Howard strives to implement all useful measures to preserve the privacy and security of users’ Data and prevent them from being altered, damaged or destroyed or accessed by unauthorized third-parties. To this end, HOWARD ensures that its subcontractors, and in particular the Service Provider, present the same technical and organizational security assurances.

HOWARD attaches the utmost importance to your right to privacy, the protection of your personal data, and the compliance with applicable regulations and, in particular, Regulation UE 2016/679 of the European Parliament and of the Council, dated April 27th 2016, relating to the protection of individuals with regard to the processing of personal data, to the free movement of such data, and to information technology, data files and civil liberties.

As part of compliance with the General Data Protection Regulation (GDPR), here at HOWARD we pursue our actions to guarantee service users, the fair, legal and transparent collection of your personal data.

The reference supervisory authority is the French Commission for Information Technology and Civil Liberties (CNIL). 

Our policy covers the processing carried out as part of Website management, as well as applications sent using the online forms and, in particular, the posting of unsolicited applications to reply to job advertisements. Primarily, HOWARD could collect your data via the Website and the social networks in the course of exchanges with clients and prospects and on subscription to newsletters.

Personal data are stored according to the obligations of the General Data Protection Regulation (GDPR), namely for a period of 3 years.

Data security and privacy

In accordance with existing regulations, users have the right to access and rectify their Data, to withdraw their consent at any time, to request the deletion of their Data, and to obtain their limitation or portability insofar as this is applicable, subject to any compelling, legitimate reasons that HOWARD could put forward to preserve such Data. Users also have the right to oppose the processing of their Data.

The above rights can be exercised at any time by sending an email to this address: howard@howard-partners.com. All requests relating to the right to access, rectify or oppose data, must be accompanied by a photocopy of a document proving the identity of the person making the request. These identity documents shall be kept for a period of one year for access and rectification rights, and for a period of three years for opposition rights.

Cookies

While browsing on HOWARD’s Website, cookies are downloaded to the user’s terminal. Cookies are small text files that may be saved in a dedicated space on the hard disk of the user’s terminal (computer, tablet, smartphone) when online services are consulted via the browser software, grouping a certain number of user browsing data (e.g. date, time and number of visits, source, preferences). Such information is never processed item by item by HOWARD.

HOWARD utilizes cookies to analyze site activity. Cookies are a means of obtaining information on site traffic and popularity and thus of measuring its performance to provide users with buttons to access HOWARD’s Twitter, LinkedIn, Facebook and YouTube accounts. If users click on one of these buttons, other cookies may be downloaded via these social networks onto their terminal. Cookies are governed by the personal data protection policy specific to each social network. As a result, HOWARD has no control over their downloading.

Downloading of cookies onto the user’s terminal assumes their consent, valid for a maximum period of 13 months. This period is not extended by any new visits made by users. When they access HOWARD’s Website, an information banner states that HOWARD utilizes this technology and that, by pursing their browsing, they accept the downloading of cookies onto their terminal. 

The data generated by cookies, used to analyze Website activity (including the user’s IP address), will be transmitted and stored by Google on servers located in the USA. This transfer of data to the USA is supervised by the Privacy Shield between the European Union and the USA. Data recipients

As part of user Data processing, HOWARD could transmit or provide access to such Data, for technical or logistic reasons only, to the following categories of Data subcontractors:

  • The Website development, hosting and maintenance provider;
  • The provider conducting intrusion tests on the Website;
  • The providers responsible for marketing analysis and client segmentation;
  • The supplier of the solution for statistical analysis of cookies and trackers.

Finally, HOWARD could be called on to communicate these Data to third-parties should such communication be required by law, a regulatory provision or a court decision, or should such communication be necessary to protect and defend its rights.

These cases aside, user Data shall not be passed on or made accessible to third-parties, subject to restructuring of HOWARD, including total or partial transfer of assets, merger, absorption acquisition, demerger and, more generally, all reorganizational operations.

Right to file a claim and applicable law

Users also have the right to recourse to the French Commission for Information Technology and Civil Liberties (CNIL), 3 place de Fontenoy – TSA 80715 – 75334 Paris Cedex 07, for all complaints relating to how HOWARD collects and processes Data.
